Terms and Conditions
These are the terms and conditions of our agreement that applies to all purchases of products by you from this website www.medicare.ie. Products include items for sale, hire and services. Please read them carefully as you agree to be bound by them when you place an order. We may change these terms from time to time so you should read them before you purchase even if you have purchased from the website on a previous occasion.
You can order a product by adding an item to your cart on the Add this product to your basket option at the bottom of each individual product/shop page. This option is placed under the product description.
When you wish to confirm your order you will be guided through the process by a series of simple instructions on the website. Registration is part of this process (please see Registration under Terms and Conditions of Use). Once you submit an order you create a contract with Medicare Health & Living Ltd. After you complete the order process we will acknowledge your order, by email, and detail the product/s you have ordered. We accept your order and complete the contract process only when the goods have been despatched. All transactions on and from the website (including but not limited to instructions, emails, order information) are in English.
We are not obliged to accept your order but would normally do so except in the following circumstances:
- The product is unavailable from stock.
- The product is not priced correctly or the product description is inaccurate.
- Your Credit Card payment has not been approved.
- The delivery address is outside Ireland. Goods will not be despatched to PO Box numbers, hotels or accommodation addresses.
In the circumstances outlined above a member of our Customer Service Team will endeavour to contact you within one working day. You are responsible for providing true, accurate, current and complete information when registering or submitting forms. All emails sent to you will be forwarded to the address given by you. If you change your email address you must advise Medicare as soon as possible. Medicare Health & Living Ltd will not be responsible for an inability to fulfil its obligations where you have given incomplete, out-of-date or inaccurate information.
We take reasonable measures to ensure that the prices set out in the website are correct. Prices are subject to change without notice and are inclusive of VAT. Prices shown on the product pages do not include delivery charges. Delivery charges are shown separately and details are given to you before you are asked to confirm your order.
Your Credit Card account will be charged at the time your goods are dispatched for delivery, except for Obstetric TENS hire, which is processed when ordered. We currently accept Visa, Mastercard and their associated cards as well as American Express, Diners and Laser Cards. Ownership of the goods passes to you once we have received payment in full. The total cost is the price of the goods plus the delivery charge.
To ensure the security of your credit card details, we use the Realex credit card payment processing system. Medicare Health & Living Ltd will not have access to the credit card details entered by you, as part of completing a transaction on this website. Before you enter your payment details you will be redirected to a secure server within the Realex domain. Rental Items – Payment: Credit or Laser Card details are required for items hired through the website, by phone or in person. Payment for items hired through this website will be via the Realex Payments system outlined above. Medicare Health & Living Ltd will not have access to the credit card details entered by you, as part of completing a transaction on this website. If you complete a rental transaction on the website you will be contacted by a member of our Customer Service Team, before your goods are dispatched. This call will be to obtain your credit/laser card details; as security for the equipment and to process future payments, should you need to extend the rental period.
We will deliver your goods to the delivery address specified by you. Delivery will be made as soon as possible after your order is received and processed. Goods are delivered by Courier next day delivery service. Normally, goods are delivered within two working days. However, this will not apply for orders submitted, through the website, on weekends or national and bank holidays. All deliveries must be signed for and you will be responsible for the goods once they are delivered. Medicare will not be liable for any delays in the Courier service, under any circumstances.
If an item is not in stock or if we delay the delivery of your goods for any reason a member of our Customer Service Team will contact and advise you as soon as possible. You agree not to hold us liable if the delivery of your goods is delayed or if your goods are damaged or defective on delivery through events or circumstances beyond our reasonable control. This includes without limitation strikes, lock-outs, computer and system malfunctions, floods, fire and accidents.
Special Offers Packages expire on the date quoted. Coupons (or special offers) may not be used in conjunction with any other existing special offers.
All products supplied by Medicare Health & Living Ltd carry the manufacturer’s standard guarantee.
Additional Terms & Conditions applicable to all Rental Equipment
- “Medicare” means Medicare Health & Living Ltd. “The Hirer” means the person or persons (incorporated or otherwise) who places an order via this website.
- The hire period begins when goods are dispatched from our office and ends on their return to our office.
- The hirer agrees that Medicare shall not have any liability for any loss, injury (including fatal injury) or damage of any description whatsoever which may be suffered or incurred by any persons as a direct result of the use, malfunction or failure of the equipment or of any part of it or the negligence of Medicare, its servants or agents. Any rights (if any) conferred on the hirer or liability to Medicare, arising by virtue of section 12 to 15 (inclusive) of the Sale of Goods Act, 1893, (as amended by the Sale of Goods & Supply of Services Act, 1980) are hereby confirmed and are not to be in any way restricted or excluded by these terms and conditions otherwise in accordance with Sections 55 of the Sale of Goods Act 1893.
Additional Terms & Conditions applicable to the hire of Obstetric Tens
- The TENS unit is supplied on the understanding that it will be used only by the hirer.
- The hirer will have discussed the use of a TENS machine with the medical personnel in charge of their care and will have received their approval.
- TENS will be used under medical supervision and guidance following the instructions provided. NB. TENS should only be used with electrodes on the mother’s back when labour has started
- Obstetric TENS is effective in the majority of cases; however it does not give total or partial relief all of the time.
- To ensure that the TENS is working normally after it has been dispatched the hirer must test the unit using electrodes placed on the arm or leg. TENS must not be used with the electrodes positioned on the mother’s back prior to 2 weeks before the due date except under medical supervision.
- The hirer should test both leads.
- The initial payment covers a 4 week period, 2 weeks before the due date and 2 weeks after. Extra periods will be charged at the set rate per week or part week.
- TENS must not be used on inflamed/broken skin, by anyone using a cardiac pacemaker, by anyone suffering from (or is suspected of suffering from) heart disease or by anyone suffering from epilepsy.
Additional Terms & Conditions applicable to the hire of Electric Breast Pumps
- Pumps must be dispatched and returned using a courier service and not ordinary regular post (except for those being collected/returned in person).
Additional Terms & Conditions applicable to the hire of Infant Respiration Monitors
A respiration monitor in no way guarantees the wellbeing of a child. The hirer must use the monitor strictly in accordance with the manufacturer’s instruction during the hire period. The hirer must not attempt any repairs or alterations to the monitor or the sensor lead.
If you change your mind you have the right to cancel your order and agreement with us within a seven day working period from the time you receive the goods. This applies to products, rentals and service. You need to contact Medicare immediately as your account will be charged once your goods are dispatched. If the goods have been dispatched or received by you please refer to the section below as it relates to return, refund and exchange procedures.
Returns, Refunds and Exchanges
We hope that you will be very happy and satisfied with any product purchased through our website. However, if you wish to change your mind, if a product is damaged or faulty we are committed to making the refund, exchange or replacement process as quick and convenient as possible. Our Customer Service Team is available to assist and advise you in relation to all the following procedures.
If you wish to return your goods or rental equipment due to a change of mind or if you wish to exchange them you must inform Medicare within a period of 7 working days from the day on which the goods were received. You can write, fax, telephone or email our Customer Service Team – details above.
If you have been charged for the goods we will refund your account within 30 days from the cancellation date. You will be liable for the cost of returning the goods to us. The goods are your property once they have been dispatched and paid for. Therefore, we recommend that you obtain proof of posting when returning items for refund or exchange to Medicare.
You are obliged to return the goods to Medicare unused and in the condition (including packaging) that you received them, within 30 days. Please include the original or a copy of your delivery note, booking form or any other documentation sent by Medicare with your goods. If this is not available please include a note stating your name, address, printout of the email from Medicare confirming your order, contact details and any other relevant information. On receipt of your goods, and verification that they are in a saleable condition, a member of our Customer Service Team will initiate your refund (less the original delivery charge). We will notify you in writing of your refund.
A refund in full ((less the original delivery charge) will be made by way of credit to your credit card (or original form of payment) for items to be exchanged. You will be contacted and advised of this by a member of our Customer Service Team, when your original order is returned. We will then charge your account for the cost of your new order and delivery charges, if applicable.
Partial refunds of up to 50% of the original price will be made for any item returned that is not in it’s original condition, is damaged by you the user or is missing parts.
You have the option to return goods and to collect goods from our office at the address above.
Returns, Refunds & Replacement/Exchanges:
For products purchased that are damaged or faulty – If your goods are damaged in transit during delivery or are faulty you must contact our Customer Service Team immediately. Our Customer Service Team is there to assist and advise you in relation to all procedures.
For a full refund or a replacement you must return the goods to Medicare within 30 days. Goods must be returned in the condition (including packaging) that you received them. Please include the original or a copy of your delivery note, booking form or any other documentation sent by Medicare with your goods. If this is not available please include a note stating your name, address, printout of the email from Medicare confirming your order, contact details and any other relevant information. You will not be liable for the cost of returning the goods to Medicare or delivery charges in relation to the replacement of faulty goods or parts.
Refunds: Once we have processed your return item, we will notify you in writing of your refund. You can expect a refund in the same form of payment originally used for purchase within 3-5 business days of our receiving your return.
Replacement/Exchanges: Once we have processed your return item, we will process your request for a replacement immediately. You will be advised throughout this procedure by a representative from our Customer Service Team. You will not be liable for the delivery charges incurred in the replacement process. Goods replaced under this circumstance are identified as a Replacement/Exchange.

Returns, Refunds & Swap-Over/Exchanges: Products rented
Returns:A minimum hire charge (equivalent to one month’s rental charge) applies to all rental equipment offered for hire through the website. If you hire products/equipment through the website you do so for a period of one month. After this period you must return the equipment to Medicare Health & Living Ltd. If you wish to hire the equipment for a subsequent rental period you are obliged to contact the Customer Service Team – details above. The Customer Service Team will advise you in relation to future payments and any other queries that you may have. Please note that if you do not return your rental equipment or contact our Customer Service Team hire charges will be processed automatically, monthly in arrears for breast pumps and monthly in arrears for infant respiration monitors (charged to your credit card or original form of payment).
Regardless of how long you hire the equipment for you are responsible for ensuring that it is returned to Medicare safely and in the same condition in which it was received. Liability for the insurance of your equipment and its return to Medicare rests with you from the time you receive it. Therefore, we recommend that you obtain proof of posting when returning equipment to Medicare.
We will send you a Proof of Return form as soon as the receipt of your equipment has been confirmed. You will not have to return sale items such as accessories and parts. These are considered as sales items and are not accepted as returns unless they are faulty or defective. Action will be taken by Medicare to retrieve the cost for the repair of any item that is not returned in its original condition, is damaged by the user or is missing parts.
Refunds: As stated above, a minimum hire charge (equivalent to one month’s rental charge) applies to all rental equipment offered for hire through the website. If you hire products/equipment through the website you do so for a period of one month. Accessories and parts are sales items and are not accepted as returns unless they are faulty or defective. Hire charges and the cost of accessories will only be refunded if:
- You change your mind, do not use your goods and notify Medicare within 7 working days after the date we deliver the products to you. (See conditions under Change of Mind heading above).
- Your goods have been damaged in transit during delivery and you do not choose the replacement option – detailed above.
- The goods develop a fault during the hire period and you do not choose the replacement option – detailed above.
Swap-Over Exchanges: In the event that your equipment is damaged in transit during delivery. Is found to be faulty on delivery or develops a fault in use you must contact our Customer Service Team immediately – details above. If you require a replacement we will endeavour to arrange it as soon as possible. You will be advised throughout this procedure by a representative from our Customer Service Team. You will not be liable for any delivery charges incurred in the replacement process. Also, you will not be liable for the cost of returning damaged or faulty goods to Medicare. However, you will be liable for ensuring the safe return of your damaged and/or faulty equipment. If your goods have been damaged in transit during delivery they should be returned to Medicare in the condition (including packaging) that you received them. Equipment replaced under these circumstances is identified as a Swap-over/Exchange.
You have the option to return goods and to collect goods from our office at the address above.
These conditions govern our relationship with you. Any changes to them must be in writing and signed by both parties.
If any one of these terms and conditions is found to be invalid that finding shall not invalidate the provisions of the remaining terms and conditions which shall remain fully enforceable.
Your Statutory Rights are not affected by these terms and conditions.
